MASSACHUSETTS BROWFIELDS RELATED LEGISLATION 2006

In July 2006 changes were made to existing state brownfields programs that were originally created through the 1998 Brownfields Act. Among the changes that were made:

  • The Brownfields Redevelopment Fund administered by MassDevelopment was recapitalized at $30 million.  A portion of that funding will be set aside to fund asbestos and lead paint abatement grants, and to conduct a study of the need for additional funding for this purpose.
  • The Brownfields Tax Credit Program administered by the Massachusetts Department of Revenue was extended until 2012, provided response actions be commenced and diligently pursued by August 5, 2011.  This credit was originally set to sunset in 2007.
  • The Brownfields Tax Credit Program was also changed to allow tax credits to be made transferable so they can be bought and sold by taxpayers and non-profit entities.
