Brownfield certification is based on the criteria outlined in section 14.5 of the Delaware Regulations Governing Hazardous Substance Cleanup:

  • All or part of property abandoned, vacant, underutilized
  • Redevelopment is hindered by environmental contamination <
  • Site is a waste release site, landfill, salvage yard, gas station, dry cleaner

Developers of Certified Brownfields may enter into "Brownfields Development Agreements" (BDAs) and obtain State funding for investigation and remediation.
